The general principles governing Chapter 3.05 of public procurement derive from the agreement, as well as from the jurisprudence of the European Court of Justice, such as transparency, equal treatment, free competition and non-discrimination.
In addition, EU-specific rules for coordination on the awarding of public contracts for works, services and goods, for traditional contracting subjects and for special sectors are applied. The legislation also specifies rules for review procedures and access to remedies. Specialized bodies are needed for their implementation.
The coordination of the procedures for the awarding of public procurement contracts by contracting authorities or entities in the field of defense and security is determined by Directive 2009/81/EC.
