The general principles governing Chapter 3.05 Public procurement arise from contracts as well as from the jurisprudence of the European Court of Justice, such as transparency, equal treatment, free competition, and non-discrimination.
In addition, specific EU rules apply to the coordination of the award of public contracts for works, services and supplies, for traditional contracting entities and for special sectors. The acquis also specifies rules on review procedures and the availability of remedies. Specialised implementing bodies are required.
The coordination of procedures for the award of public procurement contracts by contracting authorities or entities in the fields of defence and security is laid down in Directive 2009/81/EC.
